Criteria for a Qualifying Event

For an event to be deemed qualifying under Martyn’s Law, it must:

  • Take place within premises that ordinarily fall under the Standard Duty.
  • Satisfy the express permission requirement, indicating that the event has been explicitly authorised and is organised with clear oversight.
  • Exceed the capacity threshold for the Enhanced Duty, typically involving 800 or more attendees.

Example Scenario

Imagine a pub that usually operates within the Standard Tier:

  • The pub hosts a one-off music event using both the indoor premises and outdoor land, such as its garden.
  • The event attracts over 800 attendees.
  • Ticketing and Admission: Attendees are required to purchase tickets, and staff verify these tickets upon entry.

In this case:

  • The music event would be treated as a qualifying event, triggering obligations under the Enhanced Duty for the event’s duration.
  • However, the pub itself would revert to its standard tier obligations once the event concludes.

Temporary Adjustment for Public Safety

By defining qualifying events in this manner, Martyn’s Law ensures that venues hosting large-scale or higher-risk activities implement proportionate security measures without permanently altering their overall tier designation.
